Why blame the kernel? Are you sure that the NIC driver is completely stable?

src/sys/dev/pci/if_re_pci.c is the same in 7.8 as it was in 7.7 and 7.6 (revision 1.59)
and is unchanged in -current.

Meanwhile, the kernel has had lots of changes, so it wouldn't be a bad guess. It's
entirely reasonable to think that some other part of the system has failed to lock
something correctly, and an interrupt causes a device driver to run, it discovers
the issue, and panics. Blaming a device driver for reporting a problem it didn't
cause would be a case of shooting the messenger.
